Any online acknowledgments or other messages which appear on your screen for transactions entered do not mean that the transactions have been received, accepted, or rejected by SLAMCI. These acknowledgements are only an indication that the transaction information you entered has either been transmitted or cannot be transmitted to SLAMCI. No transaction shall be deemed accepted until you receive a written confirmation from SLAMCI. You are responsible for reviewing all confirmations received by you in order to verify their accuracy.
If you do not receive a written confirmation within five (5) business days of a transaction, you agree to immediately notify SLAMCI. SLAMCI reserves the right to accept or decline investments in the Sun Life Prosperity Funds pursuant to the requirements of the law or its policies. Only cleared funds will be allowed for investment in the Sun Life Prosperity Funds.
Your electronic or digital signatures or sign-in-wraps utilized in the SLAMCI Online Channels shall have the same force and effect as a manual signature and you authorize us to act upon any instructions, application, notices or requests, pertinent to the services to which you have either enrolled or utilized through the SLAMCI Online Channels, and sent using your unique electronic identification (i.e., account name and password). You acknowledge that any instructions, notices, or requests using your electronic identification can be relied upon by us to be your instructions, application, notices, or requests. We shall not be liable for acting upon such instructions, notices or requests nor shall we be obliged to investigate the authenticity or authority of persons effecting or delivering your instructions, notices or requests or verify the accuracy and completeness of such instructions, notices or requests. Such instructions shall be deemed correct, complete, irrevocable, and binding upon our receipt. You further accept full responsibility in ensuring the accuracy and completeness of your information, instructions, notices, or requests. We shall act only on those instructions, notices or requests, which we actually receive, and you agree that we do not assume any responsibility for malfunctions or delay in communications facilities that are not under our control. You also agree that it is within our absolute discretion whether to act or when to act upon such instructions, notices, or requests. Instructions, notices, or requests sent to us shall only be considered received upon our acknowledgement of actual receipt.
You acknowledge that we have the discretion to modify, restrict, deny, cancel, suspend, approve, continue or discontinue any of the e-service to which you have enrolled or which you have utilized, without any need to notify you, and that we do not assume any responsibility for technical errors, malfunctions, failure to access, delay or any similar occurrences. You are responsible for keeping your information, username, password and for the proper use of our online channels. Any damage which you or we or other third party may suffer due to the misuse of our online channel by you or another party using your account with or without your knowledge or consent, shall be your responsibility. You further agree that you shall hold us free and harmless from and shall indemnify us against any and all proceedings, claims, losses, damages or expenses arising from or in connection with the use or misuse of the online channels through your account name and password, whether by you or another party with or without your knowledge.
You shall be solely responsible for any transaction between you and your external providers such as but not limited to, your internet service provider, your bank, your credit card company, and all other third party institutions, financial or otherwise, which you use in relation to the SLAMCI Online Channels. You agree not to implead and hold us free and harmless from any dispute or issue between you and said external provider.
Neither we nor any of our respective licensors or suppliers will be liable to you under any theory of liability, for any indirect, incidental, special, consequential, punitive, or exemplary, or other damages arising out of your use or inability to use the SLAMCI Online Channels or any services or information available through them, including, but not limited to loss of revenues, loss of profits, opportunity loss or loss or corruption of data, even if advised of the possibility of such damages.
In compliance with the Know-Your-Client (“KYC”) requirement of the Anti-Money Laundering Act (“AMLA”) and its Implementing Rules and Regulations and to implement the approval of the Securities and Exchange Commission on electronic KYC, an account verification will be conducted using SLAMCI-approved information and communication technology tools, or via face-to-face at selected Client Service Centers on your first redemption or once your investment has reached the online investment threshold. Internet payment gateway ("IPG") transaction costs will not be refunded to the Investor/Applicant.
You understand, accept, and comply with the pertinent Mutual Funds’ latest prospectuses, and all the laws, regulations, and policies governing the investment. If SLAMCI believes that you may be involved in any potentially fraudulent or suspicious activity, it may take any action to protect Sun Life and its agents, including but not limited to, cancelling your application/transaction as a result thereof.
Your obligations, acknowledgements, and agreements to these Terms and Conditions shall remain effective even after de-registration.
You also agree and acknowledge that:
- Any request for reversal must be submitted to us before submitting to your appropriate third-party provider.
- We may coordinate with your agent/advisor if any, the terms of the requested reversal, if we deem it is necessary.
- We shall endeavor to notify your third-party provider of your request for reversal only upon our determination that such request is valid. We shall have sole discretion in the determination and approval of your request.
- You shall be solely responsible for following up on the actions taken by your third-party provider.
- A pending request for reversal shall not suspend the payment of any obligation or extend any period to settle an obligation, which you may have on your policy or account
